1. Agreement to these terms

These Terms of Service ("Terms") govern your use of the Gut Friendly mobile application, website, and related services (together, the "Service"). The Service is provided by Gut Friendly ("Gut Friendly", "we", "us" or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 16 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, you must have permission from a parent or legal guardian. The Service is intended for personal, non-commercial use.

3. Accounts

  • You must provide accurate information and keep it reasonably up to date.
  • You are responsible for keeping your password and device secure and for activity under your account.
  • Tell us promptly at care@getgutfriendly.com if you believe your account has been accessed without permission.
  • You may not create an account for another person without their permission or use the Service in a misleading or fraudulent way.

4. What the Service does

Gut Friendly helps you explore how food may relate to digestive comfort. Features may include food information and ratings, meal and symptom logging, portion estimates, barcode lookups, meal-photo analysis, reminders, educational content, recipes, trends, and guided programs. Features may change over time and may not be available in every country, device, or plan.

5. Important health disclaimer

Gut Friendly is an educational and self-management tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services.

Food ratings, nutrition details, symptom patterns, serving estimates, recipes, suggestions, and program guidance are general information only. Digestive responses vary between people, and information may be incomplete, outdated, or unsuitable for you.

Consult a qualified health professional before making significant dietary changes or using the Service to manage a health condition, particularly if you are pregnant, under medical care, have an eating disorder or allergy, or have persistent or severe symptoms. Never disregard professional advice because of information in the Service.

If you believe you have a medical emergency, contact your local emergency service immediately.

6. Food, allergy, and AI accuracy

Food composition, ingredients, recipes, restaurant preparation, serving sizes, and individual tolerance can change. Always check product labels and ingredient information yourself. The Service is not designed to identify allergens or guarantee that food is safe for an allergy, intolerance, or medical condition.

Barcode records may come from third-party databases. Meal-photo analysis uses artificial intelligence and may identify foods or portions incorrectly, miss ingredients, or produce other errors. You are responsible for reviewing and correcting results before relying on or saving them.

7. Your content

You retain ownership of content you submit, including meal photos, food and symptom logs, profile information, and support messages ("Your Content").

You give us a limited, worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process, and display Your Content only as reasonably necessary to provide, secure, maintain, and improve the Service. This licence ends when the relevant content is deleted from our systems, subject to reasonable backup periods and legal retention requirements.

You must have the right to provide Your Content. Do not upload images of other people, confidential documents, unlawful material, or content that infringes another person's rights.

8. Acceptable use

You must not:

  • break the law or infringe another person's rights;
  • probe, disrupt, overload, bypass, or interfere with the Service or its security;
  • access another person's account or data without permission;
  • scrape, copy, resell, or commercially exploit the Service or its food catalogue without our written permission;
  • reverse engineer the Service except where applicable law expressly permits it; or
  • use automated systems to make excessive requests or abuse photo, search, or other usage limits.

9. Third-party services and content

The Service relies on or links to third-party services, including hosting, authentication, analytics, AI, barcode data, content, app stores, and device services. Third parties may have their own terms and privacy policies. We do not control third-party services and are not responsible for their independent content, availability, or practices, except to the extent the law makes us responsible.

10. Paid features

If we offer paid features or subscriptions, the price, billing period, trial terms, and included features will be shown before purchase. Purchases made through Apple or Google are also subject to the applicable store's payment and cancellation terms.

Unless the law requires otherwise, subscriptions renew automatically until cancelled through the store account used to purchase them. Deleting the app or your Gut Friendly account may not cancel a store subscription.

11. Our intellectual property

The Service, including its software, design, branding, food catalogue, educational content, graphics, and other materials, is owned by or licensed to us and is protected by intellectual-property laws. We give you a limited, revocable, non-transferable, non-exclusive licence to use the Service for its intended personal purpose while these Terms apply.

12. Privacy

Our Privacy Policy explains how we handle personal information, including health information and meal photos. By using the Service, you acknowledge those practices. You can manage certain information and permissions in the app and your device settings.

13. Availability and changes

We aim to keep the Service available and accurate, but we do not promise uninterrupted access. Maintenance, network failures, provider outages, device limitations, or other events may affect the Service.

We may add, remove, or change features, impose reasonable usage limits, or discontinue all or part of the Service. Where reasonably practicable, we will give notice of material changes that significantly reduce a paid feature.

14. Suspension, termination, and deletion

You may stop using the Service at any time. You can delete individual logs in the app and may request deletion of your account and associated personal information by emailing care@getgutfriendly.com.

We may suspend or terminate access if you materially or repeatedly breach these Terms, create risk or harm, fail to pay applicable charges, or where required by law. Where reasonable, we will give notice and an opportunity to address the issue.

Terms that by their nature should continue after termination, including intellectual-property, disclaimer, liability, and dispute terms, will continue to apply.

15. Consumer rights and disclaimers

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, medically suitable, or that any food rating, analysis, recommendation, or third-party information will be complete or accurate.

16. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, goodwill, or opportunity arising from your use of or inability to use the Service.

To the extent our liability can lawfully be limited, our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim and AUD $100.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, wilful misconduct, or personal injury caused by negligence where the law prohibits exclusion.

17. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. Before starting formal proceedings, you and Gut Friendly agree to try in good faith to resolve a dispute by contacting the other party. The courts of Victoria have non-exclusive jurisdiction, which means applicable consumer laws may still allow you to bring a claim elsewhere.

18. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms here and update the date above. If a change is material, we will provide reasonable additional notice. Continuing to use the Service after the updated Terms take effect means you accept them.
